You can also order individual tracks from our repertoire. You then pay € 1.75 per track. You can also order the CDs from the AMP library. The CDs also cost € 12.00 per title including shipping costs.

Music Rights & Information

What about copyright?

As a media producer, you are regularly approached by providers of so-called royalty-free music. Royalty-free music is offered here as a cheap alternative to standard library music and world repertoire. It is of course your right to 'shop around' for good and affordable music and consider all possible alternatives.
But be careful, there are often pitfalls!

Royalty-free?

Music is only royalty-free when the longest-living creator (composer, lyricist, or arranger) has been deceased for seventy years or more. This includes classic composers like Mozart, Bach, Beethoven, and so on. In these cases, not only the composition rights have expired but also the intellectual property rights. All other music from providers of so-called royalty-free music does contain intellectual property rights. The creators of these compositions retain the right to determine how their music is monetized and what can or cannot be done with it. So, in short, the term royalty-free could at most mean: free of copyright, if the music is not registered with a copyright organization like Buma/Stemra and Sena. So in summary: if the composer is still alive or has passed away less than 70 years ago, the music is definitely NOT royalty-free. This applies to all types of music, whether it's production music, library music, stock music, background music, or even if you've had custom music made by a composer who is registered with a copyright organization.

Buma/Stemra

This organization is for publishers and composers who have consciously chosen to register their music works, world music, background music, production music, etc. Buma/Stemra regulates the copyright of the composer and the publisher in accordance with Dutch copyright law. In practice, only the financial aspect of the rights is regulated. Buma/Stemra collects from users and pays out to the creators. For example, it has contracts with broadcasters, and streaming services like Youtube, Vimeo, and Spotify.

Sena

This organization is for performing musicians and music producers who have consciously chosen to register their performances with Sena, which regulates the rights in accordance with the Neighbouring Rights Act (WNR). In practice, only the financial aspect of the rights is also regulated here.

When you think you are using 'royalty-free' music.

If Buma or Sena finds that registered repertoire has been used, a bill follows even if you are under the impression that you are only using 'royalty-free' music in your production. Audio Muziek Produkties therefore advises media producers who choose to exclusively use 'royalty-free' or copyright-free music to make good agreements with their provider about this. You can do this by agreeing to indemnify in cases where the offered music turns out not to be royalty-free or copyright-free after all. If you use exclusively royalty-free or copyright-free music, you do not have to pay Buma and/or Sena compensation. Streaming and other forms of broadcasting (public display) of your media production are also allowed. In the case of copyright-free music, you have already made a deal with the provider, or the composer has been deceased for more than seventy years. However, keep in mind that while the composer may have left us more than 70 years ago, the performing musicians of his/her works may still be with us. Musicians are also entitled to compensation for recordings of the reproductions. In this case, Sena will still claim compensation on behalf of affiliated performing musicians.

What about so-called Royalty-Free music?

Another commonly used alternative is 'royalty-free' music, wrongly compared to 'royalty-free' music. This is music that is issued by countless international websites and online music libraries. Users can buy a usage license per track they want to use after registration. As a user, you then get a license to use the track under certain conditions for your media production. It seems like a great alternative for Buma/Stemra repertoire for media producers. Aside from the fact that it is often difficult to find the right music, the term royalty-free is misleading. In most cases, when you buy royalty-free music, you are purchasing the (non-exclusive) synchronization right to use the chosen track (often for only one production). With synchronization rights, it means the right to put music under video. Often, multiplication is not included and, more importantly, the broadcasting right is almost never included. How come? The term Royalty-free is actually associated with (online) music providers in the United States. There, providers can make deals with Ascap/Bmi, sister organizations of Buma/Stemra, according to the copyright law prevailing there. This allows the provider to arrange the compensation without the involvement of Ascap/Bmi with the media producer. However, this ends beyond the borders of the United States and since this arrangement cannot be recognized by Buma/Stemra, when the respective music work is registered anywhere in the world, Buma will collect royalties for public performance. Here it turns out that in most cases, these music works are simply registered with (sister organizations of) Buma and Sena. For public performance, composers and publishers also want to receive compensation, and actually that is very logical.

Our advice is therefore very simple: just get the music from the Netherlands, don't compromise on quality, and just pay a little for itÂ… Your customers will also be happy with this if they don't face surprises with claims from copyright organizations afterwards. Audio Muziek Produkties actually offers all the alternative you are looking for: a small amount for copyright, an extensive selection with a website and search functionÂ… just in Dutch and because we are both the publisher and the composers of our music, we can offer you a lot of services that regular music providers cannot, namely adjusting music to your specific wishes.
